If I am seriously injured and unable to work, can i be arrested for not paying child support?
Approximately 6 months ago I sustained a triple fracture to my spine. I have a current obligation to pay child support and alimony due to the fact that my injury kept me from being able to work. I had attempted to file for modification 5 months ago through the state of CT child support Services, and it still hasnt gotten into court. I am now 7 months in arrears. I cant afford a lawyer. Am I going to jail?
Jail normally is for those who blatantly refuse to pay. The arrears will continue to accumulate and collect interest. It will also seriously affect your credit. just keep all your medical records and any paper work you have regarding your condition.
It is possible that from the day you made your petition for modification, the child support can be retro modified. That will be up to the judge. If you show sincere effort to do what you can to keep up the payments it has strong pull in court.
