custody issues and homosexuality?
im still pregnant, my daughters dad and i are not involved anymore because hes denying her after 3 years of us being together, any way, I know the paternity test will prove that she is is and thats fine and dandy i am not opposed to any visitation, i would prefer sole custody being that he has no interest in her and I dont want to get stuck consulting him over what school i want to enrol her in or taking her to my doctor as I am sure he would demand a family friend. the issue is I live with my dad and will for a little while longer, and he loves the shit out of her, shes soooooo spoiled already and hes estatic about being a gpa as is his Boyfriend. my question will my 'moral fitness' be called into question during a custody hearing. its lame enough people think homosexuals arent good parents but what about grandparents? we live in MI, any help or experience would be lovely.
Be completely honest with your Attorney! Once you give your Attorney the retainer, you have Attorney-Client privileges. Plus, the Attorneys are the ones who have relationships with other Attorneys and all the Staff including the Judges in the judicial process. So, ask your Attorney to advise you as to how they want to address or not address the matter.
By what I understand, Michigan is a no-contest divorce state which means if your divorcing, WHY your divorcing isn't necessarily the matter, what the focus is instead on is as to how you divide or settle up the assets and debts. When kids are concerned - even though your not divorcing, I would guess the same lines are considered...the court is going to want to know how best to handle the situation with the kids as to custody.
Here's the exception however - it's all about the Judge and how the Judge's thoughts are on the matter. I would guess, and make sure to ask your attorney, but I would guess the more you can show the kids are loved, well cared for, that a large focus everyday is on the children and their well-being is most important, the better off you will be. I would think the Judge would just want to see the kids happiness and adjustment and environment for growth would be a major factor (not the sexual interests of any of the adults). Then also your the Mommy, and you are the protector of the children and you/ your Attorney can demonstrate that in court as well.
But of course, disclaimer - ask your Attorney and together the two of you can work out a plan of action. Good Luck!!!
